Infertility affects 1 in 6 adults around the world. Thanks to Assisted Reproductive Technology (ART), such as In Vitro Fertilization (IVF), many families have been able to grow in ways they might not have thought possible. However, the cost of fertility treatment can often hinder someone's dreams of starting a family. Fortunately, California Governor Gavin Newsom has made strides to make these dreams more accessible for families across the Golden State by signing Bill SB729, regarding fertility treatment, into law.
California is a reproductive freedom state. As a national leader for increasing access to reproductive health care and protecting patients and providers, including those under assault in other states, I want to be clear that the right to fertility care and IVF is protected in California. In many other states this is not the case.

California Governor Gavin Newsom signed a bill regarding treatments for infertility services into law Sunday, September 29th, 2024, that expands fertility insurance coverage across the state. The law requires large group health plans and disability insurance policies (that cover at least 100 people) to provide coverage for the diagnosis and treatment of infertility.
The law is expected to go into effect July 2025. Fertility treatment can vary per patient, however, a variety of treatments will be covered under the new law.
Oftentimes, defining infertility can be ambiguous with the varying interpretations. This alone can impact one's ability to receive health coverage, let alone fertility treatment. California's new law solves this issue by broadening the definition of infertility, to ensure LGBTQ+ & same-sex couples have proper access to fertility treatment, creating an equitable approach to family-building.

This law applies to approximately 9 million California residences enrolled in large group and state-regulated health plans. Citizens who receive health coverage from religious employers or are enrolled in Medi-Cal will not have access to the benefits under this new law.
